IMPORTANT – PLEASE READ CAREFULLY. THIS AGREEMENT CONTAINS AN ARBITRATION PROVISION (“ARBITRATION CLAUSE”) REQUIRING ALL CLAIMS TO BE RESOLVED BY WAY OF BINDING ARBITRATION AND WAIVING A RIGHT TO TRIAL BY JURY AND TO PARTICIPATE IN CLASS ACTIONS. YOU MAY REJECT THE ARBITRATION PROVISION BY SENDING US WRITTEN NOTICE WITHIN 45 DAYS AFTER YOUR FIRST CARD PURCHASE.

IF YOU OBTAIN A CARD AND AUTHORIZE OTHERS TO USE IT, YOU ARE SOLELY RESPONSIBLE FOR ANY AND ALL CHARGES TO THE CARD. BE SURE TO PROVIDE THE RECIPIENT OF THIS CARD THIS CARDHOLDER AGREEMENT.

1. Cardholder Agreement for Tremendous Rewards Visa® Incentive Card

This Cardholder Agreement (“Agreement”) is an agreement between you and Sutton Bank (“Bank”) and outlines the terms and conditions under which the Tremendous Rewards Visa Incentive Card has been issued to you. Bank is an FDIC insured member institution. By accepting and/or using the Card, you agree to be bound by the terms and conditions contained in this Agreement. "Card" means the Tremendous Rewards Visa Incentive Card loaded with a specific value and issued to you by Bank.  Your Card is not FDIC insured. “Card Account” means the records we maintain to account for the value of claims associated with the Card.  “Sponsor” means an entity that provides funds in the Card Account for your use. “You” and “your” mean the person or persons who have received the Card and are authorized to use the Card as provided in this Agreement. “We,” “us,” and “our” mean Bank and its successors, affiliates, and assignees. “Website” means www.tremendous.com. Please read this Agreement carefully and keep it for future reference.  The expiration date of the Card is identified on the front of the Card (physical or virtual). You acknowledge and agree that the maximum value available in your Card Account is limited to the funds that have been loaded into your Card Account on your behalf. You have received this Card as a gratuity from Sponsor without the payment of any monetary value or consideration. Funds in your Card Account are not stored separately or on the Card. Instead, they are pooled with funds from other cardholders and held by the Bank for your benefit. Your balance will be reduced as you spend funds in accordance with this Agreement. The Card is not connected in any way to any other account. You may use the Card to make purchases at any merchant that accepts Visa debit cards, subject to your available Card Account balance and the other terms and conditions of this Agreement. Each time you use the Card, you authorize Bank to reduce the funds available in your Card Account by the amount of the transaction. The Card is not a gift card or gift certificate.  The Card is not a credit card. The Card is not for resale. You will not receive any interest on your funds in your Card Account. The Card will remain the property of Bank and must be surrendered upon demand. The Card is nontransferable and it may be canceled, repossessed, or revoked at any time without prior notice subject to applicable law. The Card is not designed for business use, and we may close your Card Account if we determine that it is being used for business purposes or in a manner that is not consistent with the intended use of the Card. We may refuse to process any transaction that we believe may violate the terms of this Agreement.

2. Activating the Card

You must activate the Card before it can be used. You may activate the Card on the Website or by calling 1-877-319-4438. In order to activate the Card, you will need to provide certain User Information so we can authenticate your identity and then select a PIN. If you experience difficulty when using the Card, please call us at 1-877-319-4438 or visit the Website.

Card and PIN Security: When selecting a PIN, do not use numbers or words that appear in your wallet (e.g., your date of birth, address, or social security number). Memorize your PIN and do not share it with anyone. You can change your PIN by accessing your Tremendous Rewards profile online at the Website. You should not write or keep your PIN with the Card.

YOU SHOULD TREAT THE CARD WITH THE SAME CARE AS YOU WOULD TREAT CASH. Always protect the Card and keep it in a safe place. Do not send the Card number in an email or text message. Make sure the Card information is secured with encryption when you use the Card to perform transactions over the Internet or wireless networks.

3. Using Your Card / Features

You acknowledge and agree that the value available in your Card Account is limited to the balance of your Card Account. You may use the Card to purchase goods or services online, by mail, or telephone wherever Visa debit cards are accepted as long as you do not exceed the value available in your Card Account. You are responsible for all transactions made with your Card, except as otherwise provided in this Agreement. If you do not have enough funds available in your Card Account for the amount authorized by you, your transaction will be declined. If you don’t have enough funds in your Card Account to cover a purchase, you can ask the merchant to split the payment — charging part to your Card and paying the rest with cash or another form of payment. This is called a “split transaction.” Some merchants don’t allow split transactions, or may only allow them if you pay the remaining amount in cash. If you use the Card number without presenting the Card (such as for an online transaction), the legal effect will be the same as if you used the Card itself in-store. You may not spend more than the available balance in your Card Account. If a transaction exceeds your balance, you are responsible for the full amount.

When making a purchase with your Card at a point-of-sale ("POS") device, you may select “CREDIT” to make a signature purchase, or “DEBIT” and enter your PIN if the device accepts debit network transactions (e.g., Pulse, Maestro).

You cannot redeem the Card for cash, use it at an ATM, or withdraw cash by any other means. You also may not use the Card for illegal transactions.

Merchant Holds on Available Funds. When you use your Card or Card number at certain merchants — like hotels, restaurants, gas stations, or rental car companies — where the final amount is unknown at the time of purchase, a hold may be placed on your available balance. The hold may be for more than the actual purchase amount and will make those funds unavailable until the merchant sends the final amount. It can take up to seven (7) days for the hold to be released.

You may also have trouble using your Card at unattended machines, kiosks, or gas pumps due to minimum holds imposed by those machines. If your Card is declined at a gas station pump, you should pay inside with the cashier.

4. Authorized Card Users

You are responsible for all transactions and fees incurred with your Card. If you allow someone else to use your Card or Card number, you will be responsible for their transactions and fees as well. You remain fully responsible for all use of the Card under this Agreement.

5. Representations and Warranties

By activating the Card or by retaining, using, or authorizing the use of the Card, you represent and warrant to us that: (i) you are at least 18 years of age (ii) you have received a copy of this Agreement and agree to be bound by and to comply with its terms; and (ii) you accept the Card.  If you are under eighteen (18) years of age, your parent or legal guardian may enter into this Agreement, and you may become an authorized user of the Card.

6. Sponsor

The Card and the funds in the Card Account are made available to you at the request of the Sponsor. The terms of any payment from the Sponsor to you, including whether such funds belong to you and the correct amount, are matters between you and the Sponsor. We have no responsibility for resolving such disputes.
