NOTICE: THIS AGREEMENT REQUIRES ALL DISPUTES TO BE RESOLVED BY WAY OF BINDING INDIVIDUAL ARBITRATION. THE TERMS OF THE ARBITRATION CLAUSE APPEAR AT THE END OF THIS AGREEMENT.

A. Using the Tremendous Prepaid Visa Card

  1. Certain Definitions

In this Cardholder Agreement "you," and "your" refers to the individual, company, or legal entity and/or entities that you represent. “We”, “us”, and “our” refer to the Issuer and Tremendous and/or their successors, affiliates and/or assignees.

“Card” or “Tremendous Prepaid Visa Card” means the virtual or physical Visa-branded payment card issued to you by Sutton Bank. The virtual Card is a digital image of a card, rather than a plastic or paper item. The Card is not a gift card, nor is it intended for gifting purposes. Funds associated with the Card are stored in a prepaid ledger subaccount held by the Issuer and are not interest bearing.

  2. About the Program

The Card will be distributed to you either physically by mail, or electronically by email, SMS, or any other method that allows for the transfer of a URL, as determined in our sole discretion.

The Card is a prepaid Card loaded with a specific amount of funds, redeemable to buy goods and services in the U.S. anywhere Visa is accepted. No additional funds may be added to this Card. In this Agreement the Card is NOT a credit card or charge card and your use of the Card will not enhance your credit rating. The Card is not a checking account or connected in any way to any account other than a stored value account where your funds are held. You will not receive any interest on the funds in your Card.

Purchases made with your Card will automatically be debited from the subaccount balance held by the Issuer in an amount equal to the purchase amount and any applicable fees. A summary of your Card transactions and balance will be available at card.tremendous.com. Your Card is not reloadable. Once your Card has been debited it will not be credited with funds again except as outlined in Section C of this Cardholder Agreement.

You can use the Card to make purchases for certain goods and services online. You can only use your Card to make purchases within the United States.

You may not use the Card or Card Account to obtain cash by any means, including at merchants, banks or at any other POS cash terminal, or from an automated teller machine (ATM).

For purposes of this Agreement, our business days are Monday through Friday. Holidays are not included.

The maximum aggregate value of the Card Account is restricted to $10,000 at any point in time. The following grid is provided to highlight the transaction limits associated with the Card Account.

Transaction Type Max Amount / Transaction Daily Max Amount Monthly Max Amount
    Purchases (POS) $10,000 $10,000 $10,000
  3. Fees

The following fee is assessed on your Card.

    | Fee Type | Fee Amount | Description | | --- | --- | --- | | Monthly Inactivity Fee | $3.95 | Applies each month after 12 consecutive months of non-use or inactivity on your Card, until the remaining balance reaches $0. |

Your purchases may be subject to additional fees from individual merchants. These fees are not assessed or received by Tremendous or the Issuer and are not included in the above chart.

  4. Requirements to use the Card

By accepting these terms, you represent that:

  5. Responsibility for Card Use

You are responsible for all transactions initiated and fees incurred by the use of your Card. You are wholly responsible for the use of the Card according to the terms and conditions of this Agreement.

  6. Setting a Personal Identification Number (“PIN”)

You do not need to set a PIN, but you may choose to do so. When you first use the Card at a merchant’s Point of Sale (“POS”) device, any four-digit code will work as the initial PIN for your first PIN-based transaction. After the first PIN-based transaction, you must use the same PIN for each subsequent PIN-based transaction, unless and until you choose to reset the PIN. Choose a PIN that you can remember easily. If you need to reset the Card’s PIN, please call 1-877-319-4438 or send an email to [email protected]. You will be required to provide information about the Card (account number, expiration date and security code) to reset the PIN.

You should not write or keep your PIN with your Card. Never share your PIN with anyone and do not enter your PIN into any terminal that appears to be modified or suspicious. If you believe that there has been unauthorized access to your PIN, you should advise us immediately, following the procedures in the section labeled “Lost or Stolen Cards; Your Liability for Unauthorized Transactions.” THIS CARD IS NOT ACCEPTED AT ATMS AND CANNOT BE USED TO OBTAIN CASH IN ANY PURCHASE TRANSACTION.
